Microbix' Obtains Patent Protection for LumiSort in the US

Microbix Biosystems Inc., a biotechnology company specializing in the development of innovative livestock reproduction technology (LumiSort), recently announced that the United States Patent and Trademark Office (USPTO) has confirmed the patentability of U.S. Patent #8,004,661 for Microbix’ LumiSort.
Interestingly, Sexing Technologies, the major player in livestock sperm sexing technology, has twice challenged Microbix’s patentability, only to have it rejected by the USPTO.
Vaughn Embro-Pantalony, president and chief executive officer, commented on the decision that the technological innovation embodied in LumiSort represents a significant advancement in sperm sexing for the livestock industry.
“Having overcome repeated attempts to invalidate our patent, it is clear that LumiSort is significantly different from prior technology and satisfies the standard for patent protection,” he said. “We will continue to defend and expand our LumiSort patent estate as the development program advances."
Dr. Mark Luscher, vice president of Scientific Affairs and the inventor of LumiSort technology, added, "Patent protection rewards innovation to stimulate economic progress. LumiSort will provide significant benefits for the livestock industries and food production worldwide, and the innovative foundation of our technology has now been twice affirmed by the U.S. Patent Office."
LumiSort not only increases the sperm cell yield and speed of production, but increases the fertility of the sexed sperm cell product as well.
Microbix has already signed agreements for marketing LumiSort with companies worldwide, and is poised to enter a global animal reproduction market for artificial insemination valued at over $3 billion.
Microbix will receive a royalty of about 15 percent of the selling price from all of these global companies.
The company is also in the process of signing a further agreement with more distributors to provide them with the instrument the company expects to be the future of livestock artificial insemination.
Established in 1988 and headquartered in Canada, Microbix Biosystems, Inc. specializes in the development of biological technologies, and has intellectual property in large market products including the animal reproduction technology (LumiSort).
