Ballistic Case Company Files Infringement Claim Against Valor Communications

By Rory Lidstone, TMCnet Contributing Writer

The parent company of Ballistic Case Company, A.G. Findings & Mfg Co., recently stated that it has filed a complaint of unfair competition and infringement of its intellectual property rights against Valor Communications. This complaint was filed in the U.S. District Court for the Southern District of Florida and it alleges that Valor has infringed AGF's intellectual property rights related to its Shell Gel Series of protective cases.

In terms of financial compensation, AGF is asking for damages, attorneys' fees and court costs, as well as the destruction of the infringing Valor cases and an injunction against the import and sale of those cases.

“Ballistic’s products are associated with innovative designs, engineering expertise, and high quality materials, and we’ve filed the lawsuit against Valor to stop the company from copying our product designs,” said Alan Kleinman, CFO of A.G. Findings & Mfg, in a statement. “The market for protective device cases is large enough that companies should not have to resort to copying the designs of industry leaders like Ballistic.”

Kleinman went on to add that Ballistic is an innovator in terms of high quality protective cases and that protecting the company's intellectual property rights ultimately protects the interests of its customers.

Strangely, AGF released a very similar statement in June 2012 regarding Valor infringing on Ballistic's Shell Gel protective cases.

Ballistic Case Company is a designer of advanced accessories for mobile electronics devices. The company began producing rugged cases for electronics in the last few years with the goal of building the best engineered case on the market, with the highest degree of drop protection and customer satisfaction.

In August 2012, the company joined Construction Connection's new Partners Program as a way to expand its market and reach more potential customers. The Partners Program is meant not only to help companies like Ballistic, but its customers as well as users who can use ConstructionConnection.com to port and find jobs.
