Plaintiffs Trying to Get Class Action Lawsuit against Time Warner Cable on New Modem Fee

The company recently began charging customers the modem fee in New England, New York, Pennsylvania and in North and South Carolina the rental fee, according to news reports.
The two lawsuits were filed in New York and New Jersey courts, just a few days after the fee started to get charged.
They claim the $3.95 per month modem lease fee "not only violates its customer agreements, but misleads customers about virtually every aspect of the modem scheme," the Portland Press Herald reported quoting court documents.
The lawsuits were filed by Kathleen McNally of New York City and Natalie Lenett of Fort Lee, New Jersey, according to TMCnet. The two are represented by Attorney Steven Wittels and The Roth Law Firm in New York City.
The Roth Law Firm is looking for other potential plaintiffs to join the lawsuit.
On the firm’s website, it asked, “To contact us regarding your own experience with Time Warner’s internet modem lease fee, please email us your contact information and a brief description of your experience.”
As of June 30, Time Warner Cable reported it has some 10.8 million residential high-speed Internet customers, according to news reports. The New York Daily News reported that Time Warner Cable could end up paying some $500 million from the legal action – which could potentially affect 15 million customers.
“It’s just a scam to increase revenue,” Wittels was quoted by the Daily News.
"You can't do this to the little guy," Roth added.
Time Warner Cable told the media it doesn’t comment on pending litigation.
