Las Vegas Court Orders Seizure of Righthaven Assets
The U.S. Marshals Service will seize more than $63,000 in Righthaven assets following a court order in Las Vegas. The case relates to a “website poster,” Wayne Hoehn, who got a judgment for legal fees after winning the lawsuit Righthaven filed against him, say news reports. The lawsuit related to Hoehn posting a Las Vegas Review-Journal article on a sports-betting website, according to news reports.
U.S. District Judge Philip Pro threw out the lawsuit and told Righthaven to pay Hoehn's lawyers in Las Vegas, the news reports add. Arguing it should not have to pay, Righthaven claims it may go into bankruptcy after its assets are seized. Righthaven was described by the Las Vegas Record-Journal as “a company that files copyright infringement lawsuits.” Righthaven has found the money for attorneys in other cases in Nevada, Colorado and South Carolina, VegasInc said. In addition, attorneys for Righthaven appealed the dismissal and judgment to the 9th U.S Circuit Court of Appeals in San Francisco. In a statement, Steve Gibson, Righthaven CEO, says the company will prevail and “people ought to be able to engage in private contracts to uphold copyright ownership." Vegas Inc. reported that, since March 2010, Righthaven has filed “275 lawsuits against websites, bloggers and message board posters claiming they infringed on material from the Las Vegas Review-Journal and the Denver Post by posting their content online without authorization.” The writ on Tuesday relates to $34,045 in legal fees and an additional $30,000 in fees from the Randazza Legal Group. "Righthaven has exhausted any benefit of the doubt that it could be afforded, and it is time for it to pay the consequences for its actions — starting with Hoehn’s lawful judgment plus the accrued costs and fees expended in the (so far) futile attempts to compel Righthaven to take this court’s orders seriously,’’ Randazza attorneys stated in a document quoted by VegasInc.
